1. About this policy

1.1. D M Dunningham Limited trading as Dunninghams (“we”, “us”, “our”) is committed to protecting information that identifies you (your “Personal Information”) and ensuring that we comply with the Privacy Act 2020 when dealing with personal information. 

1.2. This Privacy Policy explains how we will collect, use and disclose your personal information, and how you can exercise your rights in relation to your personal information.

1.3. This Privacy Policy applies when you:

(a) Access and use our website;
(b) Place orders with or purchase products from us, including as a website customer with a registered account or as a guest; 
(c) Apply for and trade on a credit account with us; and
(d) Use any services we provide in relation to our goods. 

We will refer to these as our “Goods” and “Services” in this Privacy Policy.

1.4. We may need to update this Privacy Policy from time to time. The most recent version will be published on our website https://dunninghams.co.nz. The change will apply from the date we upload the updated policy. This policy was last updated in September 2023.

2. What personal information we collect

2.1. We collect personal information about you, which may include your:

(a) Contact details including your legal name, trading name, delivery address, postal address, email address, telephone number, mobile number;
(b) Details about you including your date of birth and drivers’ licence number;
(c) Bank account details (for the purposes of a direct debit authority);
(d) Other information that you submit regarding the Goods and Services.

3. Who we collect your personal information from

3.1. We collect your personal information directly from you, where this is possible and practicable.

3.2. We may also collect your personal information:

(a) from someone else, where you have authorised this;  
(b) from publicly available sources;
(c) from credit reporting agencies for the purposes of assessing your credit worthiness; and
(d) automatically, when you visit our website, such as your IP address, web pages you viewed and links you clicked on. Some of this information is collected using cookies (text files saved on your device) and similar tracking technologies.

4. Why we collect your personal information

4.1. We collect your personal information for the following purposes:

(a) To process and deliver orders to you; 
(b) To process applications for credit accounts;
(c) To communicate with you regarding the Goods and Services;
(d) To verify your identity;
(e) To undertake credit checks of you (if necessary);
(f) To invoice you and collect money that you owe us;
(g) To provide relevant marketing and advertising relating to our Goods and Services;
(h) To improve our Goods and Services based on your feedback;
(i) To protect and/or enforce our legitimate business interests and legal rights, including defending any claim and compliance with regulatory and audit functions;

4.2. If you do not provide us with some of the personal information we request, we may be unable to provide you with the Goods or Services you have requested. 

5. Who we share your personal information with

5.1. There may be times where we need to share your personal information with third parties. We will only disclose your personal information to:

(a) Third-party payment providers to process web shop orders paid by credit card. We do not retain credit card information;
(b) Third-party service providers of accounting software to enable us to invoice you for the Goods;
(c) Third-party service providers of shipping/delivery services;
(d) Third-party service providers for the purpose of maintaining our website and IT systems;
(e) Credit reference agencies, for the purpose of carrying out a credit check on you if you apply for a credit account with us; 
(f) Regulators, law enforcement bodies, government agencies, dispute resolution providers, or other third parties where we consider it necessary to comply with applicable laws or regulations, or to exercise or defend our legal rights. Where possible and appropriate, we will notify you of this type of disclosure; and
(g) Other people or agencies, where authorised by you.

5.2 We may disclose your Personal Information to service providers who are located outside of New Zealand, such as cloud storage providers.  We will use reasonable endeavours to ensure that Personal Information transferred overseas is protected in accordance with this Privacy Policy.    

6. How long we keep your personal information

6.1. We will keep your personal information for as long as we have a legal or business need to retain it. 

7. How we keep your personal information secure

7.1. We will take reasonable technical and organisational precautions to prevent the loss, misuse or unauthorised alteration of your personal information. However, due to the nature of email and the internet, we cannot guarantee the privacy or confidentiality of your personal information. We may store your information in cloud or other types of networked or electronic storage.

8. Children’s personal information 

8.1. Our website is for a general audience of customers and is not geared towards children. We do not sell Goods for purchase by children, and we do not knowingly collect personal information from children under the age of 16. If we discover that we have inadvertently collected the information of a minor and are not required to retain it for legal purposes, we will promptly delete it.

9. Cookies and Tracking

9.1. Cookies are text files that are stored on your computer or device when you visit certain web pages.  We may use cookies to:

(a) Remember your preferences and settings;
(b) Personalise your use of our services;
(c) Enable us to improve the content, reliability and functionality of our website;
(d) Enable you to use certain services or functionality;
(e) Evaluate the effectiveness of our content and advertising; and
(f) Track and understand usage. 

9.2. Third parties may set cookies during your visit to our website for remarketing purposes in particular to show you goods and services that you may be interested in.

9.3. Accepting a cookie will not give us access to any data on your computer other than the data stored in the cookie.

9.4. You can set most internet browsers to notify you when you receive a cookie and to give you the opportunity to decide whether or not to accept it.  You can also disable all cookies generally.  In some instances you may be required to accept certain cookies in order to use our website.

9.5. Some web browsers incorporate a “Do Not Track” (“DNT”) or similar feature that signals to websites that a user does not want to have their online activity tracked.  If a website that responds to a particular DNT signal receives the DNT signal, the browser can block that website from collecting certain information about the browser’s user.  Not all browsers offer a DNT option and DNT signals are not yet uniform. Our website currently does not respond to DNT signals. 

10. Third Party Links

10.1. Our website may contain links to third party websites.  These websites may or may not have privacy policies similar to our own.  We recommend that you check any relevant privacy policies or statements before providing your Personal Information to any third party.  We have no responsibility for Personal Information provided to third parties or for the policies or practices of third parties.  You access any third party websites at your own risk.

11. Your rights

11.1. Subject to applicable law, you have the following rights in respect of your Personal Information:

(a) Right of Access - to request access to your Personal Information; 
(b) Right of Rectification – to request that we rectify your Personal Information if it is inaccurate or incomplete;
(c) Right to Erasure – to request that we erase your Personal Information in certain circumstances:

i. It is no longer necessary for us to hold the Personal Information;
ii. You withdraw consent and there is no other ground for the processing; or
iii. You object to the processing and there are no legitimate grounds for processing; and

(d) Right to Restrict – to request that we stop processing some of your Personal Information.

11.2. We will respond to your requests within a reasonable time period.  Whilst we will respond to your requests we may not be required to comply with your requests where an exception or limitation applies under applicable law.

11.4. You can also cease the use of your Personal Information for marketing purposes by using the unsubscribe feature in any message that we send to you.

12.1. If you have any concerns or complaints about the manner in which your Personal Information has been collected or managed by us, please contact us using the details below.

12.2. We will endeavour to resolve any complaint to your satisfaction. However, if you are unhappy with our response, you may contact the Privacy Commissioner who may investigate your complaint further. Further information about the application of the Privacy Act can be found at the website of the Privacy Commissioner at www.privacy.org.nz.
